READ CAREFULLY
CONCERNING THEFT OR LABOR, SERVICES, OR THE USE OF PROPERTY, AND PROVIDING PENALTIES THEREFORE CONLORADO REVISED STATUTES 40-14-25

Section I - theft or use of personal property. Any person who obtains the temporary use of personal property of another, which is available only for hire, by means of threat or deception or knowing that such use is with out the consent of the person providing the personal property, of another which is available only for hire, who willfully fails to reveal the whereabouts of or to return said personal property to the owner thereof or his representative or to the person from whom he has received it within seventy-two hours after the time at which he agreed to return it, where the value of the personal property involved is one hundred or less shall be guilty of misdemeanor and upon conviction thereof shall be punished by a fine not exceeding one thousand dollars or by imprisonment in the county jail for a period not exceeding one year, or by both such a fine and imprisonment.

TERMS AND CONDITIONS

All equipment is used at lessee's risk. We exercise care in keeping our equipment in good condition. Conditions which prevent satisfactory use do not relieve lessee of his/her responsibility for rental charges.

Kentec Communications, Inc., operator/lessor, agrees to keep the basic paging system in satisfactory and operating working conditions and to use all reasonable care to maintain the same including each individual paging unit, in satisfactory working and operating condition; however, operator/lessor shall be responsible only for reasonable maintenance and care and is not responsible for accidents or damage which are not within operator/lessor's reasonable control and is not responsible for outage or damage resulting from acts of God, such as weather, storm and the like.

NO WARRANTY IS MADE AS TO COVERAGE, AVAILABILITY, OR GRADE OF SERVICE PROVIDED. IN NO EVENT SHALL OPERATOR/LESSOR BE LIABLE FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE EQUIPMENT. IN NO EVENT SHALL OPERATOR/LESSOR BE LIABLE FOR ANY LOSS OF USE, LOSS OF TIME, INCONVENIENCE, COMMERCIAL LOSS, LOSS PROFITS OR SAVING OR OTHER INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH PRODUCT, OT THE FULL EXTENT SUCH MAY BE DISCLAIMED BY LAW.

Operator/lessor will use public power and public communications systems such as telephone and is not responsible for outage or any loss or damage which may result or may be caused by failure to public power or communications systems.
All equipment is used at owner/lessee's risk. We exercise reasonable care in keeping our equipment in good condition; however, conditions which prevent satisfactory use do not relieve owner/lessee of his responsibility for maintenance/rental charges.

Owner/Lessee assumes full responsibility for equipment while out of possession of operator/lessor, and promises to return equipment to the operator/lessor on the date and hour agreed to in good condition as received, natural wear from a reasonable use expected. Owner/Lessee shall be liable for any loss, theft, damage or destruction of leased property. All equipment lost or damaged beyond repair will be paid for by owner/lessee at the regular replacement cost and all damaged equipment which may be repaired will be repaired by the operator/lessor on return thereof and the cost for such repairs shall be paid by the owner/lessee. The owner/lessee also agrees to pay for any missing or unaccounted for items if not returned with the equipment. Scheduled rental rates begin when the equipment leaves our place of business and continues until returned thereto.

The owner/lessee agrees, upon thirty day written notice, to modify, convert, or replace his mobile equipment in order to conform to any changes made by the operator/lessor to its system, including, but not limited to, changes in signaling techniques, number of channels, channel scanning techniques, automatic number identification and/or other operation techniques and technical improvements consistent with providing the maximum utilization of the operator/lessor's frequencies. Such equipment modification, conversion, or replacement shall be the sole responsibility of and effected at the sole cost of the owner/lessee who has elected to furnish his own mobile equipment.

Lessee assumes full responsibility for equipment while out of possession of lessor, and promises to return equipment to the lessor on the date and hour agreed to in as good condition as received, natural wear from a reasonable use excepted. Lessee shall be liable for any loss, theft, damage or destruction of leased property.

All equipment lost or damaged beyond repair will be paid for by lessee at the regular replacement cost and all damaged equipment which may be repaired will be repaired by the lessor on return thereof and the cost for such repairs shall be paid by the lessee. The lessee also agrees to pay for any missing or unaccounted for items if not returned with the equipment. All cartage charges to or from the lessee's property of place of use must be borne by the lessee. Scheduled rental rates begin when the equipment leaves our place of business and continues until returned thereto.

Lessee complies with Part 90.75 of the FCC Rules and Regulations, which states that those who subscribe must be "primarily engaged in any of the following activities:" "the operation of a commercial activity . . . the operation of educational, philanthropic, or ecclesiastical institutions . . . clergymen activities . . . the operation of hospitals, clinics, or medical associations."
